Collapsed Car Seat Back Injury

back injury

You have every right in this modern age to expect your motor vehicle to keep you reasonably safe in a variety of crash situations. In fact, auto makers invest millions of dollars investigating, testing and updating various components on their vehicles, all in the interest of public safety. However, one area of automobile safety has escaped serious scrutiny until recently, and that is collapsing automobile seat backs. In fact, many people have suffered a back injury or worse because of this safety defect.

A Serious Problem

Automobile crash tests demonstrate what can happen when a seat collapses. The driver is driven violently backward and in most cases incurs a serious back injury, or worse. Moreover, when a passenger is riding behind the driver’s seat, the driver is launched into the passenger, causing both to suffer injury or even death. This has been documented in far too many cases.

The National Highway Traffic Safety Administration (NHTSA) contends that no significant research exists to build a case for changing the existing seat back standard and if doing so would reduce the risk of injury. But, according to an investigation conducted by CBS News in 2016, utilizing both interviews with lawyers and reviewing court cases, they identified “more than 100 people nationally who were severely injured or killed in apparent seat back failures since 1989. The majority were children. Seventeen have died in the past 15 years alone.”

What If I Suffered a Back Injury Due to a Collapsed Seat Back?

Despite years of legal action and millions of dollars paid to injured consumers, the automotive industry continues to produce motor vehicles with unsafe seats that fail in the event of an accident. If you were involved in an accident where the seat back collapsed and caused injury to you or your passengers, you should contact Edwards and Patterson Law for a consultation.
