5 Questions to Ask Your PI Lawyer

If you have been injured in an accident, there are many variables that affect your situation. The extent of your injuries, medical costs, loss of future income or opportunities and more are all considerations that must be weighed carefully. Before you enter into a dialogue with those responsible for the accident or any insurance company representatives, you need the guidance and advice of a professional personal injury attorney. A qualified PI lawyer can help you understand what options are available and answer questions regarding possible compensation.

Can Any PI Lawyer Help Me?

If this is your first time becoming involved with the courts, and particularly with personal injury attorneys, it can be confusing and a bit disconcerting. Many lawyers advertise claims of experience and success rates regarding personal injury cases. However, you should not believe everything you hear on television or read on the internet at face value. Unfortunately, not every attorney is qualified to handle personal injury matters, nor do they possess the experience and relationships necessary to successfully handle your case. Make your choice carefully. Remember, you are in the driver’s seat.

What are the Top Questions to Ask?

Always arrange a face-to-face consultation in order to get to know any prospective PI lawyer. Make a list of questions and concerns you have regarding your case. Ask each one and only settle for specific answers. Record all information you are provided by the attorney. Here is a list of the top 5 questions you should ask:

  1. How many personal injury cases have you handled successfully? Ask for credentials and establish a level of experience. Ask for references from former clients. Inquire about the relationships the attorney has formed with other officers of the local court system.
  2. Will you be the actual attorney handling my case? Law firms often employ legal assistants to handle research, leg work, answering the phones and various other tasks. Some even allow them to pursue cases on their behalf. But you need an attorney. Ask who you will speak to when calling. Who will actually represent you before other parties and in the courts? Don’t settle for anything less than an experienced and compassionate PI lawyer to handle your case from start to finish.
  3. Do you have the time necessary to handle my case now? Delays in filing and presenting your case will harm your possible outcomes. Inquire about how many current cases the PI lawyer is juggling. If they are unable to give you a time frame for filing and presenting your case, it’s time to move on to the next candidate.
  4. Will my case actually go to trial? If the attorney you are interviewing prefers to work a settlement up front, be wary. Unless an attorney is prepared to go to trial for your case, you will not be guaranteed the best possible result. Don’t settle for what you can get from a lazy PI lawyer. Most settlements reward the lawyer more than you.
  5. What is your contingency fee? Most PI lawyers work on a contingency fee, which means you pay no money unless you are awarded compensation. The attorney typically takes a percentage of that, usually between 25%-40%. However, don’t hesitate to negotiate. If your case involves serious damages or has a strong possibility of success, this leaves you more room for negotiation.
